01. Introduction & Acceptance

This website at www.sarabouzykcoaching.com (the “Site”) is operated by Sara Bouzyk, trading as Sara Bouzyk Coaching (“we”, “us” or “our”), a Hong Kong–based executive and leadership coaching practice.

These Terms of Service (the “Terms”) govern your access to and use of the Site. By accessing or using the Site, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Site.

02. Scope — Website vs. Coaching Services

These Terms apply to your general use of the Site only. They do not, by themselves, create any coaching, advisory or other professional relationship between you and us.

Our coaching services are provided separately and are governed by a dedicated Coaching Agreement, which a client enters into when engaging and paying for those services. Where you are a coaching client, the Coaching Agreement governs that engagement and prevails over these Terms in the event of any conflict in relation to the services.

03. Permitted Use of the Site

You may use the Site for lawful, personal and informational purposes. By using the Site, you agree that you will not:

  • Use the Site in any way that breaches any applicable law or regulation

  • Attempt to gain unauthorised access to, interfere with, damage or disrupt the Site, its servers or any connected systems

  • Introduce viruses, malware or other harmful material

  • Copy, reproduce, republish or commercially exploit any part of the Site except as expressly permitted in these Terms

  • Use the Site to transmit unsolicited communications or to collect data about other users

The Site is intended for adults. By using it, you confirm that you are at least 18 years of age.

04. Informational Purpose — No Professional Advice

All content on the Site is provided for general information only. It describes our approach to executive and leadership coaching and does not constitute psychotherapy, counselling or mental health treatment; legal advice or legal services; financial planning, investment advice or accounting services; business consulting or management consulting; or medical advice or diagnosis, and should not be relied upon as such.

Reading the Site, completing a contact form, or booking an introductory call does not create a coaching relationship. Coaching begins only once a Coaching Agreement is in place. You remain responsible for any decisions or actions you take based on information found on the Site.

05. No Guarantee of Results

Coaching is a collaborative process, and outcomes depend substantially on each individual’s own circumstances, effort and decisions. Any examples, descriptions or testimonials on the Site are illustrative only and are not a promise or guarantee of any particular result, outcome or financial, professional or personal benefit.

06. Enquiries, Bookings & Payments

The Site may allow you to contact us, book an introductory or coaching session, or make payment, using third-party tools such as Calendly (scheduling), Stripe (payment processing) and Zoom (video sessions). Your use of those tools is subject to their own terms and privacy policies, and we are not responsible for them.

Submitting an enquiry or booking request is not acceptance of a contract by us. Paid coaching is confirmed and governed by the separate Coaching Agreement and the applicable fees set out at the time of engagement.

07. Intellectual Property

All content on the Site — including text, graphics, logos, branding, frameworks, models, tools, worksheets, images and layout — is owned by or licensed to Sara Bouzyk Coaching and is protected by applicable intellectual property laws.

You may view and print pages from the Site for your own personal, non-commercial reference. You may not otherwise copy, reproduce, distribute, modify, publish or commercially exploit any part of the Site without our prior written consent. All rights not expressly granted are reserved.

08. Third-Party Links

The Site may contain links to external websites and services that we do not operate or control, including our social media profiles on Instagram and LinkedIn. These links are provided for convenience only. We have no control over, and accept no responsibility for, the content, products, services or privacy practices of those third-party sites, and we encourage you to review their terms and policies.

09. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and protect personal data and is available at www.sarabouzykcoaching.com/privacy-policy. By using the Site, you acknowledge that you have read the Privacy Policy.

10. Disclaimer — Site Provided “As Is”

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations of any kind, whether express or implied, that the Site will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components, or that any content is accurate, complete or current.

We may update, suspend, restrict or withdraw all or part of the Site at any time without notice.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any loss or damage — whether in contract, tort (including negligence), breach of statutory duty or otherwise — arising out of or in connection with: your use of, or inability to use, the Site; any reliance you place on content on the Site; any interruption, delay or unavailability of the Site; any virus, malware or other harmful material that may affect your equipment through your use of the Site; or any third-party website or service linked from the Site. This includes, without limitation, any indirect, incidental, special or consequential loss, and any loss of profits, revenue, data, goodwill or business opportunity.

The Site is made available to you free of charge. These limitations and exclusions reflect a fair allocation of risk between us in light of that, and are a condition of your use of the Site.

11.1 Liabilities Not Excluded

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be limited or excluded under applicable law.

11.2 Maximum Liability

To the extent any liability cannot lawfully be excluded but may be limited, our total aggregate liability to you, arising out of or in connection with your use of the Site, shall not exceed the greater of: (a) the total amount (if any) you paid to us to access the Site, which for a freely available site is nil; or (b) HKD 500.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or applicable law. The current version will always be available on the Site, with the date of last update shown at the top. Your continued use of the Site after any change constitutes acceptance of the updated Terms.

14. Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or your use of the Site, are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.

Subject to any mandatory rights you may have under the consumer-protection laws of your country of residence, the courts of the Hong Kong SAR shall have exclusive jurisdiction.

Where you have entered into a signed Coaching Agreement with us, the governing-law and jurisdiction provisions of that Agreement govern the coaching relationship between us. The provisions of this Section apply to your use of the Site. As both specify the Hong Kong SAR, no conflict is intended.

A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) of Hong Kong to enforce any of these Terms.
